By using KitchenCubes.com or by clicking “I agree” to these terms and conditions, you (“User”) signify your agreement to the following terms and conditions. If you do not agree to the following please do not use this site and do not click “I agree”. Kitchen Cubes LLC retains the right to periodically revise these terms and conditions, and all such revisions or modifications will be posted on this site. Kitchen Cubes recommends that you periodically visit this page to review the terms and conditions, as continued use of the site after the terms and conditions have been revised or    modified shall constitute acceptance of the terms and conditions as modified.

Orders Placed on the Site
These terms and conditions are incorporated into every purchase made on this site, and you may order products on this site only upon acceptance of these terms and conditions. Upon placing an order, you agree to pay the price of the product plus shipping charges as well as any applicable sales tax.  The Company reserves the right to decline your order for any, or no, reason, and The Company further reserves the right to terminate the usage of this site by any. All sales are Final! To meet our industry leading delivery schedules, we pull your order as soon as we receive it. Therefore we cannot accept order cancellations, changes or returns.

Delivery and Non-Conforming Products
As Kitchen Cubes secures its products from a number of different manufacturers that ship via a number of different carriers, Kitchen Cubes does not guarantee shipping times. It is your responsibility to make sure that the goods are in compliance with your order at the time of delivery. If the goods are not in compliance or are damaged, you must refuse delivery of items. Acceptance of delivery is considered as an assertion by you that the goods are in compliance with the terms of the order. Any problems discovered after acceptance of delivery may result in additional expense being incurred by you.

Order Changes or Cancellations
Changes or cancellations to an order are NOT accepted once the order has been processed. There are no returns accepted on product unless  product arrives damaged. See Damaged Product Section Below.

Defective/Damaged Product
Customer must report concealed (non visible) damages within 48 hours of delivery and a replacement will be shipped NO CHARGE with freight prepaid.  If the customer does not report the damage within 48 hours of delivery, it is the responsibility of the customer to purchase a new item to include purchase price + shipping and handling. In order for a replacement part to be reordered a picture of the damaged product must be taken and e-mailed to support@KitchenCubes.com Replacement parts will be shipped to customer as soon as they are made.

Limitation of Liability
Kitchen Cubes liability to you and / or any third party is limited to the price paid by you to Kitchen Cubes for products purchased through this site. Under no circumstances shall Kitchen Cubes be liable for any lost profits, or special, incidental, or consequential damages, however they should arise.

Dispute Settlement
Any dispute relating in any way to your usage of this site shall be settled in accordance with the laws of the state of Wisconsin

Jurisdiction and Venue
I hereby agree that in the event of a lawsuit regarding this transaction or any warranty, jurisdiction and venue shall lie in Palm Beach County, Florida and the laws of the State of Florida shall apply.

Lead Time
All cabinetry and other stock products will ship within 3 weeks from date of purchase.
Actual shipping time may change or be extended as the result of order processing issues, shipping location, scheduling or multiple project kitchen orders.  Customers will be notified if shipping times will change. 

Freight/Delivery Terms and Conditions
Orders placed with KitchenCubes.com will be shipped to home or jobsite via a KitchenCubes.com delivery vehicle or a national LTL carrier. All shipments are valid for one customer, to one location in the continental United States. Deliveries are made to the home or job site of the purchaser only. Shipping and handling charges cover one delivery attempt to customer.  In the event that, due to customer availability or other customer circumstances, an order is not deliverable, the customer will be responsible for additional shipping and handling. Deliveries are tailgate delivery only.  For this type of delivery (per ICC regulations), drivers are only required to bring product to the tailgate (end) of the vehicle.  It is the customer’s responsibility to remove product from vehicle. All shipments will be palletized and shrink wrapped.

Receiving
The customer must receive, inspect, and sign for all deliveries. Items should be checked against the bill of lading and packaging slip supplied by the driver for each delivery. The bill of lading indicates the number of cartons in the delivery.  It does not represent the number of pieces as some items may be boxed together such as molding, hardware, etc. Cartons with multiple items will have separate labels on the carton for each item included and be so labeled on the packing slip.

Privacy
We only use the information you provide about yourself when placing an order to complete that order.  We do not share this information with outside parties except to the extent necessary to complete that order.

Customer Order Approval and Processing
All orders need signed customer approval with appropriate deposit paid in full before Kitchen Cubes will process an order.

Order Changes or Cancellations
Changes or cancellations to an order are NOT accepted once the order has been signed and processed. 

Back Order Items
In the event of a backorder, Kitchen Cubes will contact customer and advise of the back ordered item. Backordered items will be shipped to jobsite without any additional shipping charges added.

Lead Time
Homestead Cabinetry ships within three weeks of order placement, Haas Cabinetry ships within four weeks of order placement. Actual shipping times may be extended as the result of order processing issues, shipping location, scheduling or multiple project kitchen orders. Customers will be notified if shipping times will change.

The customer must receive and inspect all deliveries. Cartons with multiple items will have a single label listing the various items in each carton.

Damage/Defective
If the item(s) that you purchased become damaged during shipment, please document the damage with the delivery driver upon delivery and notify Kitchen Cubes immediately by calling 262-694-3736. Customer must report concealed (non visible) damages within 48 hours of delivery and a replacement will be shipped NO CHARGE with freight prepaid.  If the customer does not report the damage within 48 hours of delivery, it is the responsibility of the customer to purchase a new item to include purchase price + shipping and handling.

Installation Services
If Kitchen Cubes is providing installation for products purchased from Kitchen Cubes, Kitchen Cubes will be responsible for any damaged products being installed. Damaged products installed by Kitchen Cubes that were not purchased from Kitchen Cubes will be the responsibility of the customer to have them replaced. Product purchased from Kitchen Cubes that is not installed by Kitchen Cubes that is damaged during install will not be replaced free of charge, and will be the responsibility of the customer to purchase new product. In addition, any moldings or panels that are cut incorrectly and a shortage occurs the customer is responsible to pay for additional material needed to finish job. In the event Kitchen Cubes tears out a soffit, plumbing, and or electrical items and it is found out that additional plumbing or electrical work is required from what was hidden by existing soffits or cabinets, the price of completing the job may increase or the customer will have the option of bringing in a third party to complete the work needed in order to finish installing the cabinets, countertops, sinks and faucets.

Warranties

Haas & Homestead Cabinets FIVE-YEAR LIMITED CABINETRY WARRANTY:
Cabinets manufactured by Haas Cabinet Co., Inc., are warranted to be free from defects in material and workmanship under normal use to the original consumer purchaser for a period of five (5) years from the date of purchase. This warranty is not transferable to subsequent owners. Unfinished product is not covered under this warranty.

Most Haas cabinet doors are solid wood. These doors will perform well in a variety of conditions if properly stored, handled, and installed. All wood products are designed and intended for controlled interior applications only. Any solid wood product will respond adversely to extreme conditions–especially extremely low or high humidity conditions. Mitered doors joints are especially subject to movement under these extreme conditions. Gaps that may develop in door joints due to these conditions are not subject to replacement under this warranty.

LIFETIME LIMITED WARRANTY ON DRAWERS, DRAWER GUIDES AND HARDWARE:
All drawers manufactured by Haas Cabinet Co., Inc., are warranted to be free from defects in material and workmanship for as long as the original consumer purchaser owns the home where installed. All drawer guides and hinges are warranted by the

manufacturer to be free from defects in material and workmanship for as long as the original consumer purchaser owns the home where installed. These warranties are not transferable to subsequent owners.

Haas warranties apply only to product used in single-family, non-rental, non-commercial residences. This warranty does not cover damage from misuse, abuse, neglect, improper storage, defects caused by installation or storage or transportation, moisture or heat-related damage, normal wear and tear, or acts of God.

Should defects in material or workmanship exist during this warranty period, Haas will elect at its discretion to either repair or replace free of charge the defective material or component, excluding labor costs. This warranty covers only parts and materials supplied by Haas, and does not cover costs for removal or reinstallation of counter tops, plumbing fixtures, appliances or related materials, or labor costs. Natural and environmental factors will affect cabinet products over time; therefore, Haas cannot be held responsible for replacement product that may not exactly color-match installed product.

Haas periodically updates and makes changes to its product line and specifications. If a warranty claim is filed against obsolete or changed product, Haas will replace the part(s) under warranty with a new part of the same style or with a similar style currently offered. Haas cannot be held responsible for replacement product that may not exactly match installed product.

THIS WARRANTY IS THE EXCLUSIVE WARRANTY OF HAAS CABINET CO., INC. HAAS CABINET CO., INC., DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE.

Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.

To submit a warranty claim, the original consumer purchaser must contact the Haas dealer or distributor where the product was purchased. A copy of the original dated sales receipt must be presented as proof of purchase. The Haas dealer or distributor will contact the Haas sales representative who will inspect the product and submit his/her findings to the company for response.

Laminate, Staron, and Marble Countertops and Products
Kitchen Cubes will, at its option, repair or replace without charge any product we sell where our inspection reveals a defect in workmanship or materials for a period of one year after original installation. Kitchen Cubes is not responsible for labor costs regarding removal, return or reinstallation and is not responsible for other materials used in the installation. Implied warranties including that of merchantability are expressly limited in duration to the duration of this warranty. Kitchen Cubes disclaims any responsibility for consequential damages. Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so this limitation and exclusion may not apply to you. This warranty gives you specific legal rights. You may have other rights that vary from state to state.

Silestone and Sensa Granite Countertops and Products
Cosentino USA offers this limited warranty to end users of Silestone products. For a period of ten years from the date of installation, Cosentino, USA warrants that the Silestone products will be free from manufacturing defects. This limited warranty does not apply to color variances, thermal shock, chemical abuse or defects caused by misuse. If a manufacturing defect occurs within the warranty period, Cosentino, USA will at its option, repair or replace the defective Silestone products at no cost to the end user, including labor charges.

Except as specifically provided herein, Cosentino, USA makes no express or implied warranties of merchantability or fitness for a particular purpose. Except as specifically provide herein, Cosentino, USA shall no e liable in either tort or contract for any loss or damage, whether direct, indirect, consequential or incidental arising out of the manufacturing, fabrication, installation or use of Silestone products.

Sink and Faucet  Products
Kitchen Cubes will, at its option, repair or replace without charge any sink or faucet we sell where our inspection reveals a defect in workmanship or materials for a period of one year after original installation. Kitchen Cubes is not responsible for labor costs regarding removal, return or reinstallation and is not responsible for other materials used in the installation.
